These Terms of Service ("Terms") govern your access to and use of KSafety, including the website, web application, dashboards, templates, compliance records, EHO report pack, subscription features, support services, label tools, AI-assisted features where available, and any related tools or content.
KSafety is operated by Ksafety LTD, registered in England and Wales under company number 17232016, with registered office at 66 Paul Street, London EC2A 4NA.
By creating an account, starting a trial, subscribing, logging in, or using KSafety, you agree to these Terms. If you use KSafety on behalf of a business, you confirm that you have authority to accept these Terms for that business. If you do not agree, you must not use KSafety.
KSafety is a digital compliance recordkeeping and management platform for hospitality businesses. It helps users organise and manage food safety and health & safety records, including daily records, temperature logs, HACCP-related documentation, allergen records, corrective actions, pest control records, cleaning records, supplier records, traceability records, risk assessments, incident records, COSHH records, staff training records, audits, dashboards, labels, and EHO report packs.
KSafety is a support tool. It does not replace the customer's responsibility to comply with food safety law, health and safety law, employment law, data protection law, insurance obligations, local authority requirements, or professional advice.
Customers are responsible for setting up their accounts accurately, entering truthful and complete records, training staff to use the platform properly, reviewing records, responding to alerts, completing corrective actions, maintaining suitable procedures, and keeping their business information current.
Customers must ensure they have appropriate rights and lawful bases to upload staff information, business records, supplier information, incident details, photographs, signatures, and other content. Customers must not upload unlawful, misleading, discriminatory, defamatory, unsafe, excessive, or unnecessary sensitive data.
KSafety is designed to help businesses manage records and evidence. It does not guarantee compliance, EHO approval, a food hygiene rating, safe operations, audit success, legal defence, risk reduction, insurance acceptance, or regulatory outcomes. Customers remain responsible for understanding and meeting their own duties and should obtain competent professional advice where required.
If KSafety includes AI-assisted features, such as suggested wording, templates, summaries, prompts, corrective-action suggestions, audit observations, risk-assessment assistance, or plain-English explanations, those outputs are for general operational support only. AI outputs may be incomplete, inaccurate, outdated, or unsuitable for a particular business.
Customers must review all AI-assisted outputs before relying on them. AI outputs are not legal advice, regulatory approval, professional food safety advice, professional health and safety advice, or a guarantee of compliance.
Customers must keep login details secure and must not share credentials with unauthorised persons. Customers are responsible for activity under their accounts. Customers should remove access for former staff and should use appropriate role permissions where available.
KSafety may suspend or restrict access where we reasonably believe an account is being misused, compromised, used unlawfully, used in breach of these Terms, or creating risk to KSafety, other users, or the public.
New subscribers receive a 14-day free trial. Subscription terms, trial periods, prices, VAT treatment, billing cycles, renewal dates, cancellation options, and any hardware or label-printer terms are shown clearly during checkout and in the Subscription, Cancellation and Refund Policy.
Unless stated otherwise during checkout, paid subscriptions renew automatically until cancelled. Customers are responsible for reviewing the plan, price, billing cycle, renewal terms, site/user limits, included features, and hardware conditions before subscribing.
Customers must use KSafety lawfully and responsibly. Customers must not misuse the platform, attempt unauthorised access, interfere with security, upload malware, scrape or overload the service, reverse engineer the platform where prohibited by law, use KSafety to create false records, or use the service in a way that harms other users, staff, inspectors, regulators, or the service.
Customers retain ownership of the records, files, and information they upload or create in KSafety. Customers grant Ksafety LTD the rights needed to host, process, display, back up, export, analyse, and otherwise use customer content to provide, secure, support, and improve the service.
Customers are responsible for the accuracy, legality, relevance, and completeness of customer content. KSafety is not responsible for compliance failures caused by missing, inaccurate, incomplete, late, misleading, or unsuitable customer-entered records.
KSafety, including its software, workflows, design, branding, templates, documentation, report formats, text, images, interface elements, and platform materials, is owned by Ksafety LTD or its licensors. Customers may use KSafety only as permitted by these Terms.
No rights are transferred to customers except the limited right to access and use KSafety during an active subscription or authorised trial.
We aim to provide a reliable service, but we do not guarantee uninterrupted availability. Maintenance, updates, outages, security events, third-party failures, or circumstances beyond our reasonable control may affect access.
We may improve, modify, suspend, or discontinue features where necessary. We will aim to avoid materially reducing core paid functionality without reasonable notice where practical.
KSafety may integrate with or rely on third-party services, such as hosting, payment processing, email, analytics, AI tools, authentication, support tools, or label-printing services. We are not responsible for third-party services except to the extent required by law or expressly stated in these Terms.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or other liability that cannot be excluded under applicable law.
To the fullest extent permitted by law, KSafety is not liable for indirect loss, loss of profit, loss of business, loss of goodwill, loss of data caused by customer failure to export or maintain records, regulatory outcomes, inspection outcomes, food hygiene ratings, enforcement action, or losses caused by customer failure to maintain accurate records or follow appropriate procedures.
Customers may cancel their subscription as explained in the Subscription, Cancellation and Refund Policy. We may suspend or terminate accounts that breach these Terms, create security risk, fail to pay fees, misuse the service, or use the service unlawfully.
After termination, access to records may be limited. Customers should export important records before closing an account or allowing a subscription to end.
We may update these Terms from time to time. Where changes are material, we will take reasonable steps to notify customers, such as by email, website notice, or in-app notice. Continued use of KSafety after changes take effect means the updated Terms apply.
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, unless mandatory consumer law provides otherwise.
